Background Information
 



The Embu County Government (ECG) is established under the Constitution of Kenya which provides for 47 county governments as part of the devolved government structure. 



The Constitution provides for the Counties to become fully operational after the 2013 general elections. 


 


The ECG derives its mandate from Chapter 11 of the Constitution of Kenya, Part 2 of the Fourth Schedule as further elaborated by the County Government Act 2012.




This request for expression of interest follows the expiry of existing framework agreements through which the Embu County Government has been procuring the services of legal counsels.




Objectives of the assignment



 
The object of the assignment is to get competent senior counsel (s) and legal consultants who will be handling specific matters where and when needed, depending on the nature and complexity of the matter. 



The evaluation criteria for the bids will be based on the following:




Senior Counsel


  • Must be an Advocate of the High Court of Kenya;

  • At least 15 years legal experience ideally in a reputable organization;

  • Proven track record of providing accurate and effective legal advice and representation of legal matters at both Court of Appeal and Supreme Courts of Kenya; and

  • Meets the requirements of Chapter Six of the Constitution.


Scope of work
 



The senior counsel (s) will be expected and not limited to, when he or she is required to act-


  • be the principal legal adviser (s) to the County Government;

  • be responsible for negotiating, drafting, vetting and interpreting local and international documents, agreements and interpreting international treaties for and on behalf of the County Government and its agencies;

  • by way of leading counsel(s) represent the County Government in court in any legal proceedings arising from county legislation or any other legislation to which the County Government is a party or has interest where and when the need arises;

  • handle litigations that bear public interest and represent any member of the public in matters that the Governor or the County Attorney deems to be of public interest;

  • be responsible for advising all County Government departments and agencies of the county on legislative and other legal matters;

  • be responsible for advising the County Government on all matters relating to the Constitution, national legislations, county legislations, international law, human rights, and consumer protection.


Legal Consultant


  • Bachelor’s Degree (or its accredited equivalence) in law from a recognized university ;

  • A masters degree will be an added advantage;

  • Must be an Advocate of the High Court of Kenya;

  • At least 8 years legal experience in practice;

  • Proven track record of providing accurate and effective legal advice; and

  • Meets the requirements of Chapter Six of the Constitution.


Duties and Responsibilities
 



The Legal Consultant will be working under the leadership of the Senior Counsel and will do the following, among other duties:


  • Reviewing and advising executive on legal implications of internal policies and procedures

  • Reviewing and drafting bills contracts, agreements and internal policies and ensuring that they are in compliance with all statutory or legal requirements

  • Reviewing progress of outstanding litigation specific cases

  • Providing and interpreting legal information, conducting training and disseminating appropriate legal requirements to staff

  • Providing continuous leadership, supervision, training, and development of staff ensuring effective and motivated team

  • Preparing, reviewing and modifying contractual instruments to assist and support various business activities and

  • representing the county government on specific matters where the county deem fit without engaging the Senior Counsel.
