Constitution Process Adviser


I. General Information

Expected places of travel:Nairobi and Somalia (security permitting)
Supervisor:Constitution Building Project Manager
Anticipated presence at UNDP premises: full-time presence

II. Objectives of the assignment

UNDP in collaboration with the Independent Federal Constitution Commission and the Ministry of Constitution and Federal Affairs designed the “Somalia Constitution-Making” support project to support the constitution-making process in such a way as to ensure that it strengthens peace, begins a process of national reconciliation, and creates a foundation and road map for longer term state-building and nation building. The project contributes towards the following outputs:
1. A consultative and inclusive constitution making process is undertaken
2. Somali public has a good understanding of constitution making process and key issues to be decided.
3. The views of the public are heard and growing consensus is achieved in relation to major constitutional issues.
4. Draft constitutional text is prepared and meets standards of state practice.
5. All major interest groups understand and, to the extent possible, support the draft presented for referendum.

Transitional Federal Charter of the Somali Republic of 2004, mandates the Independent Federal Constitution Commission (IFCC) to draft the federal constitution. The Commission in this task is supported by a secretariat headed by a Secretary General and supported by two deputies, finance and administration director and a team of dedicated staff and consultants.

UNDP wishes to recruit a short term senior advisor to support and advice the IFCC Deputy Secretary General (DSG) for Media, Public Outreach and Civic Education on civic education, public outreach, consultations, management of public submissions, public relations and liaising with media
III. Scope of work

Terms of Reference

Technical Advice on Public Consultation
•Develop a template to guide the preparation of the individual Public and Technical and Consultation Reports
•Develop a template to guide the preparation and compilation of the Commission’s Main Report on Public Consultation – “What the people say”
•Advice and develop a template to guide the Commission on the consideration and adoption of the Final Constitutional Document and Final Report.
•Advice on the preliminary analysis of oral and written memoranda received by the IFCC as at the time of completion of collection of views
•Support the IFCC and it partners to prepare and compile its Reports including a summary of its recommendation on public consultation and civic education.
•Assist in targeted consultation sessions and analysis of data and public consultation reports

Technical Advice on the Commission’s Consideration of Public Feedback and Responses to CDC

•Under the guidance of core technical experts, provide technical advice on the consideration of public feedback and response to the CDC based on the Commission’s Report and Revised CDC
•Assist the IFCCand its core technical experts in scrutinising the Articles of the CDC and comparing it with the content of the Commission’s Report to verify whether provisions contained in the CDC are consistent with the views of the public
•Develop, under the guidance of core technical experts guidelines for the Commission for the examination of all issues raised during the public and technical consultations and any other issues touching on matters emerging from consultations
•Assist the IFCC and its core technical experts in consolidating and compiling its Reports

Technical Advice to Political and Transitional Strengthening Unit SIDP

•Provide technical advice on the development of process management for the political and transitional strengthening Unit
•Provide technical advice on the development of the transitional plan, prioritization of task including the required milestones, sequencing, timeline, actions needed and performance indicators and result indicators
•Assist the Political and Transitional Strengthening Unit in development of policy, administrative, legislative and institutional and operational structures, systems and strategies necessary for the implementation and realization of the transitional tasks
•Assist the Political and Transitional Strengthening Unit to develop a prioritized implementation matrix for the transitional tasks clearly categorizing the immediate, interim, long-term tasks
•Assist the Political and Transitional Strengthening Unit to develop effective mechanisms for supporting the coordination and implementation of key transitional tasks as well as necessary strategies and technical assistance programmes

IV. Monitoring and Progress controls

The consultants will work under the overall supervision of the Constitution Building Project Manager. A work plan for the consultancy will be developed and agreed to no later than two days after the start of the assignment. Evaluation of the SSA contract will be made against the benchmarks and deliverables set for the assignment of the consultant at the end of the contract duration.

V. Final product/deliverable

Detailed monthly report, which will include.

VI: Review/approval time

The performance of the contractor will be reviewed on bi-monthly basis to approve outputs prior to authorization of payments.
VII: Qualifications

? Master’s Degree or equivalent in Law, political science, or related field
? 7-10 years of relevant experience in law, public administration, civic education advocacy programmes;
? Experience in working with stakeholders, donors, UN agencies is an asset
? Excellent command of written and spoken English
? Demonstrable knowledge of or experience in horn of Africa an advantage
? Good understanding of conflict and conflict sensitive reform processes
