1. Background

In pursuance of its mandate, the Interim Independent Electoral Commission (IIEC) in conjunction with UNDP Amkeni Wakenya is seeking to prepare a Voter Education Handbook on Elective positions under the 2010 Constitution.

The Voter Education Handbook on Elective Positions is intended to provide direction to Kenyans to understand the new electoral system and provide insights into the new structures under the Devolved Government.

Amkeni Wakenya is a UNDP led facility set up to promote democratic governance in Kenya. Amkeni Wakenya was established in July 2008, then known as the “Civil Society Democratic Governance Facility (CSDGF)” and works through Civil Society Organizations in the areas of democracy, human rights, governance reforms, and the integration of a rights based approach in social and economic reforms in Kenya.

The Interim Independent Electoral Commission (IIEC): The Interim Independent Electoral Commission (IIEC) - or its anticipated successor, the Independent Elections and Boundaries Commission (IEBC) - is mandated by the Constitution to manage the electoral process and conduct elections and related activities in the country.

Specifically, Section 88 (4) (g) of the Constitution mandates the electoral body to undertake voter education.

Pursuant to consultations between the two organizations, and in furtherance of shared objectives, the IIEC in partnership with Amkeni Wakenya intends to produce a Handbook and IIEC materials on Elective Offices under the 2010 Constitution. The Handbook will also cover: campaigns, nominations, election regulations, election offences, independent candidates, party lists, election disputes resolution, right of recall etc.

Scope of Consultancy:

a) In consultation with the Director Voter Education and Partnerships at the IIEC, determine the scope, uniqueness, content and methodology of a Voter Education Handbook on Elective Positions and other appropriate IEC materials such as fliers, brochures among others.

b) Take a lead role in literature review and research on relevant and appropriate content and messages.

c) Provide an inception report outlining how the task will be undertaken including providing clear timelines and milestones.

d) Collate, analyze, synthesis and compile a draft voter education handbook on elective positions

e) Formulate relevant and appropriate themes, chapters and sub chapters of the handbook

f) Develop specific messages to be used in Information, Education and Communication (IIEC) materials.

g) Facilitate a minimum of four workshops for IIEC Commissioners, staff and stakeholders to build consensus on the content of the Handbook

h) Facilitate one day validation/peer review worship on the handbook and other IIEC materials for 40 stakeholders.

i) Take the lead in piloting and pre-testing of IIEC materials

j) Work closely with an illustrator in finalizing the handbook

k) Submit 2 copies of the final draft of the handbook and IIEC materials in both hard and soft format.

Expert Profile: Skills, Experience & Qualifications

Masters Degree in Political Science, Human Rights, Law, Gender and Development, Social Sciences and any other related field.At least 7 years in civic and voter education and democratic governance issues.Demonstrated knowledge of the governance sector and political processes in KenyaDemonstrated knowledge and experience in electoral reformDemonstrated knowledge on political communication and messagingVery good understanding and familiarity with Kenya’s political and socio-economic environment, and the constitution making process;Demonstrable commitment to values of social justice, human rights, inclusivity, diversity, nation building and gender equity;In-depth understanding and knowledge of the work of civil society organizations in Kenya;Demonstrable commitment to values of social justice, human rights, inclusivity, diversity, nation building and gender equity;Good writing and communication skillsCultural awareness and sensitivityCommitment to UNDP and IIEC principlesComputer literacy in Microsoft Software and IT packagesApplication procedure

II. Objectives of the assignment

UNDP in collaboration with the Independent Federal Constitution Commission and the Ministry of Constitution and Federal Affairs designed the “Somalia Constitution-Making” support project to support the constitution-making process in such a way as to ensure that it strengthens peace, begins a process of national reconciliation, and creates a foundation and road map for longer term state-building and nation building. The project contributes towards the following outputs:
1. A consultative and inclusive constitution making process is undertaken
2. Somali public has a good understanding of constitution making process and key issues to be decided.
3. The views of the public are heard and growing consensus is achieved in relation to major constitutional issues.
4. Draft constitutional text is prepared and meets standards of state practice.
5. All major interest groups understand and, to the extent possible, support the draft presented for referendum.

Transitional Federal Charter of the Somali Republic of 2004, mandates the Independent Federal Constitution Commission (IFCC) to draft the federal constitution. The Commission in this task is supported by a secretariat headed by a Secretary General and supported by two deputies, finance and administration director and a team of dedicated staff and consultants.

UNDP wishes to recruit a short term senior advisor to support and advice the IFCC Deputy Secretary General (DSG) for Media, Public Outreach and Civic Education on civic education, public outreach, consultations, management of public submissions, public relations and liaising with media
III. Scope of work

Terms of Reference

Technical Advice on Public Consultation
•Develop a template to guide the preparation of the individual Public and Technical and Consultation Reports
•Develop a template to guide the preparation and compilation of the Commission’s Main Report on Public Consultation – “What the people say”
•Advice and develop a template to guide the Commission on the consideration and adoption of the Final Constitutional Document and Final Report.
•Advice on the preliminary analysis of oral and written memoranda received by the IFCC as at the time of completion of collection of views
•Support the IFCC and it partners to prepare and compile its Reports including a summary of its recommendation on public consultation and civic education.
•Assist in targeted consultation sessions and analysis of data and public consultation reports

Technical Advice on the Commission’s Consideration of Public Feedback and Responses to CDC

•Under the guidance of core technical experts, provide technical advice on the consideration of public feedback and response to the CDC based on the Commission’s Report and Revised CDC
•Assist the IFCCand its core technical experts in scrutinising the Articles of the CDC and comparing it with the content of the Commission’s Report to verify whether provisions contained in the CDC are consistent with the views of the public
•Develop, under the guidance of core technical experts guidelines for the Commission for the examination of all issues raised during the public and technical consultations and any other issues touching on matters emerging from consultations
•Assist the IFCC and its core technical experts in consolidating and compiling its Reports

Technical Advice to Political and Transitional Strengthening Unit SIDP

•Provide technical advice on the development of process management for the political and transitional strengthening Unit
•Provide technical advice on the development of the transitional plan, prioritization of task including the required milestones, sequencing, timeline, actions needed and performance indicators and result indicators
•Assist the Political and Transitional Strengthening Unit in development of policy, administrative, legislative and institutional and operational structures, systems and strategies necessary for the implementation and realization of the transitional tasks
•Assist the Political and Transitional Strengthening Unit to develop a prioritized implementation matrix for the transitional tasks clearly categorizing the immediate, interim, long-term tasks
•Assist the Political and Transitional Strengthening Unit to develop effective mechanisms for supporting the coordination and implementation of key transitional tasks as well as necessary strategies and technical assistance programmes

IV. Monitoring and Progress controls

The consultants will work under the overall supervision of the Constitution Building Project Manager. A work plan for the consultancy will be developed and agreed to no later than two days after the start of the assignment. Evaluation of the SSA contract will be made against the benchmarks and deliverables set for the assignment of the consultant at the end of the contract duration.

V. Final product/deliverable

Detailed monthly report, which will include.

VI: Review/approval time

The performance of the contractor will be reviewed on bi-monthly basis to approve outputs prior to authorization of payments.
VII: Qualifications

? Master’s Degree or equivalent in Law, political science, or related field
? 7-10 years of relevant experience in law, public administration, civic education advocacy programmes;
? Experience in working with stakeholders, donors, UN agencies is an asset
? Excellent command of written and spoken English
? Demonstrable knowledge of or experience in horn of Africa an advantage
? Good understanding of conflict and conflict sensitive reform processes

III. Scope of work

? Advise the IFCC on the technical and legal needs of the IFCC thematic and legal drafting committees, with specific focus on human rights issues.
? Assist the IFCC with the management of thematic experts as well as legal drafters for the IFCC thematic and legal drafting committees.
? Support the IFCC in conducting and commissioning legal research and analysis as well as development of knowledge based tools such as policy positions, practice notes, concept papers and research papers on key constitutional issues, with a specific focus on human rights concerns.
? Coordinate and advise on the International Consultation process and coordinate mechanisms to ensure that data collected from the International Community during the consultative stage of this process is done in an efficient and timely manner.
? Analyze consultation submissions from the International Community (including from thematic experts) and provide the submissions and analysis in a timely and understandable manner to the IFCC in order to assist them in the final drafting process.
? Serve as the main POC and support the IFCC in human rights focused public consultations.
? Provide comparative reviews of the CDC with (1) the TFC; (2) the Puntland Constitution; (3) the Somaliland Constitution; (4) the Somali Constitution of 1960; and (5) the Somali Constitution of 1990.
? In consultation with the core technical experts, advise IFCC legal drafting committee on the technical aspects of legal drafting and document management, including translation.
? Assist the IFCC in managing all IFCC documents and verification of draft legal texts and reports.
? Support the IFCC with preparation of ad hoc committee progress reports for the IFCC plenary, PCC, MoCFA, donors and UNDP
? Support the IFCC through the final decision making and drafting stage of the process.
