Baseline Survey: Local Non-State and State Actors Engagement in KNCHR’s Public Complaints Referral Mechanism

The Kenya National Commission on Human Rights (KNCHR) in partnership with GIZ-Social Justice Reconciliation and National Cohesion project, seek the services of a consultant / consulting firm to conduct a baseline survey in the North Rift and Northern Kenya regions in the month of September, 2011.

The overall aim of the baseline study is, on behalf of KNCHR, to collect and analyze data for making an initial assessment on the existing regional complaints referral systems in place, used by KNCHR and in collaboration with other institutions - both State and Non-State.

The results of the study are to serve as the baseline for measuring the use of the referral system and the satisfaction by key stakeholders of the usefulness of the referral system.

The Kenya National Human Rights Commission is an independent National Human Rights Institution and was established by the Government through the Kenya National Commission on Human Rights Act No. 9 of 2002.

Its core mandate is to further the protection and promotion of human rights in Kenya. It plays two broad roles firstly as a watch dog over the government in the area of human rights and secondly as a leader in moving the country toward a Human Rights State.

The consultant/consulting firm is expected, in close collaboration with KNCHR and GIZ;

i) To prepare a baseline survey to make an initial assessment of the existing regional referral system in place, used by KNCHR and other institutions - both State and Non-State, focusing on North Rift and Northern Kenya regions and the prospects/positioning of the KNCHR regional offices for an integrated complaints mechanism

ii) To assess the role of CSOs in complaints handling and challenges experienced in engaging with KNCHR in the referral system

iii) To use appropriate qualitative and quantitative data collection and analysis methodology, to allow for future evaluation indicators on the use by and usefulness of the referral system to the relevant State and Non State Actors

iv) To design and provide key quantitative and qualitative indicators for evaluation from the data analysis to measure the use of the referral mechanism and the usefulness of the referral system to the relevant State and Non-State Actors in the mid and long term

v) To provide suitable recommendations for KNCHR in its current public complaints referral mechanisms

The African Union (AU), UNEP and UNECA in cooperation with the African Roundtable on Sustainable Consumption and Production (ARSCP) and African Organisation for Standardisation (ARSO) have launched the development of the African Eco-labelling Mechanism (AEM). The German Federal Ministry of Environment, Nature Protection and Nuclear Safety (BMU) has provided funding for the initial phase of the institutionalization of the AEM within the framework of the Task Force on Cooperation with Africa founded in the course of the Marrakech Process. The implementing agency for this Project Phase of the Mechanism is GIZ in close cooperation with ARSO. The AEM Secretariat has been set up and is hosted by ARSO. AEM’s governance structures comprising of an Executive Board, a Technical Board and Sector Working Groups are being established. One of the main project objectives is to develop an African sustainability standard on which Benchmarking and a certification process with an Eco-label will be based on. Another main task will be to define a viable strategy to ensure long-term financial self-sufficiency of the AEM. The marketing of the eco-label in cooperation with international partners will be another decisive task of the project. Finally, the project aims at developing the capacity of African accreditation and certification bodies and facilitating access of producers to certification.

Responsibilities
As Executive Manager, you will be a member of the project team that develops and institutionalizes the AEM in close cooperation with relevant regional, continental and international organisations. You will play a key role in ensuring the project's success and in achieving the objectives agreed with BMU in line with the Marrakesh Process. You will be responsible for the implementation of the programme strategy and for the promotion of the AEM across the continent and internationally. Together with the partner organisations as well as other members of the project team, you will lead the project so as to ensure the long-term sustainability of the AEM programme.

In this context, you will work closely with the Executive Board, AEM programme coordinator, the project manager responsible for the contract and cooperation at GIZ’s Kenya Office and colleagues from GIZ headquarters in Germany who will support the project implementation, particularly as regards developing the standards and benchmarking system and drawing up a marketing concept. You will coordinate and support economic and political networking for AEM. You will be required to report progress of project implementation to the AEM Executive Board biannually.

To ensure the long-term viability of the AEM program it is highly desirable that you develop a commitment to the AEM beyond the project phase.

Qualifications
You have a Master’s degree in political or social sciences, economics, environmental or agricultural sciences, or in a similar area, and have gained at least ten years of experience as an advisor or manager. You have comprehensive expert knowledge on voluntary sustainability standards and you are perfectly acquainted with environmental and climate protection. You are perfectly acquainted with the diverse cultural backgrounds on the African continent, you have finely tuned communication skills, are an excellent networker, excel under pressure, and act sensitively in an intercultural environment.
Proficiency in English is a must and fluency in French would be an asset.

You will act as deputy to the Executive Manager and cooperate closely with the other project staff and the officer responsible for the contract and cooperation at GIZ’s Kenya office to ensure the project’s success and the achievement of the objectives agreed upon with BMU and the AEM Executive Board.
You will support the project’s steering and implementation and its coordination with regional and national authorities as well as Sector Working Groups. You will be responsible for the management of project activities as well as the project’s monitoring and evaluation. Furthermore, you will cooperate closely with the advisory team from the responsible department at GIZ headquarters, which supports the design of the initiative and in particular the development of the standards and benchmarking system and the design of the marketing strategy.
To ensure the long-term viability of the AEM programme it is highly desirable that you develop a commitment to the AEM beyond the project phase.

Qualifications

You have a Master’s degree in agricultural, political, social, economic or environmental sciences and you have already gained at least 5 years of professional experience. You have proven your excellent management skills in international projects and you are a committed team player. You have excellent communication skills, you are accustomed to act in a diplomatic and sensitive manner in a multicultural working environment and you are able to adjust to multiple demands and shifting priorities. Sound knowledge and ideally experience in advising or developing voluntary sustainability standards would be an asset and you should be perfectly acquainted with the diverse cultural backgrounds on the continent. Proficiency in English is required and fluency in French is an asset.
