Programme: GIZ – Health Sector Program

Position: Senior Programme Officer- Sexual Reproductive Health Component

Reports to: Component Head- Sexual Reproductive Health

Location: Nairobi

Background:

The Health sector is one of the priorities of German Development Cooperation (GDC) with Kenya. The overall objective of the German Programme is, “Access to good and affordable health care, particularly in reproductive health is improved.”

The German programme supports the Kenyan government in implementing the National Health Sector Strategic Plan as well as in the consecutive planning processes arising from the SWAP. The programme combines - as a cross – cutting issue - human rights aspects, HIV / AIDS and other areas.

Scope:

The Senior Programme Officer will support the Component Head in strategic, programmatic, administrative and financial management of the component activities with special focus on de-central level activities.

Responsibilities:

Management of de-central level RH activities according to the Programme Offer, the component objectives and the annual work plan ,Support the RH component’s initiative to provide professional advice and input to, and to cooperate with, implementing partners and relevant stakeholders, andInnovation and knowledge management as well as transmission of innovation to a wide range of personsWithin this context, s/he fulfils the following tasks:

Specific Tasks:

Responsible for planning, coordination and implementation of assigned SRH activities as per the component work plans, including travel to the respective GIZ focal districts. This will be done in close coordination with implementing partners and relevant stakeholders;Represent the programme in relevant stakeholder forums including those dealing with policy and technical aspectsNetworking, advocacy and public relations ;Establish and maintain effective collaborative working arrangements with the Provincial / District Health Management Teams and future county teams;Establish partnerships with relevant stakeholders in the GIZ focal districts in the area of SRH and strengthen existing ones;Prepare the budget for assigned component activities and related financial documentationConceptualises, prepares and implements workshops, coordinates trainings, and other events as outlined in the SRH component work plan;Supports the component head in monitoring and evaluation of the component activities. This includes review of relevant documents on progress of component activities, determining bottlenecks and recommending alternative courses of management action to the component head;Supports research and study activities as outlined in the annual work plan, including appropriate input to the program reports/publications;Additional Tasks:

Any other tasks assigned by the Component Head

Required Entry Qualifications and Competencies:

Post graduate degree in public health or related fieldsUndergraduate degree in either health or natural sciencesKnowledge and experience with the medical, cultural and anthropological aspects of SRH including linkages to HIV/AIDS;Knowledge and experience in gender and Reproductive rights issues;Previous experience in policy dialogue and technical advisory role;At least 5 years work experience in sexual reproductive health or related health programs within East Africa;Previous management experience in a similar program is preferred, including financial oversight/managementProven leadership skills and experienceTeam player with broad social skills, high inter-cultural sensitivity and good negotiation skillsStrong oral and written communication skills.Excellent command of MS-OfficeHow to apply:

Background
The Republic of Kenya is party to most of international and regional conventions and protocols related to human rights of women and gender empowerment and equality. In the last five years the Government has taken progressive steps to address the issue of the sexual and gender based violence through adoption and implementation of broad national policies and strategies and substantive laws, including the 2006 Sexual Offences Act. This Act specifically regulates responses to the crimes of sexual and gender-based violence, defines sexual offences and establishes minimum sentences, as well as provides for victim protection/treatment and progressive practices in the investigation and prosecution. In 2008, the Attorney General of the Republic of Kenya established a Section on Prosecution of Sexual Offences in the Department of Public Prosecutions of Kenya (DPP) dealing with sexual and gender-based violence offences. In addition, the Kenya Police established gender desks in several stations throughout the country to ensure that cases of gender-based violence are reported to the Police and that victims have access to support services. Despite progress in this area, there are a number of challenges that prevent victims of sexual and gender-based violence to access legal justice and have their rights protected and restored. Most of gender-based violence cases remain unreported by individuals who often face obstacles in trying to bring the alleged perpetrators to justice.
In view of the above and the request from DPP and the National Task Force on Implementation of the Sexual Offences Act (NTF SOA), UNODC, in collaboration with the German Technical Cooperation (GTZ), initiated the process for developing a training manual and curriculum for Prosecutors and Police officers to improve their knowledge, skills and competence in handling cases of gender-based and sexual violence and provide necessary support to victims. The consultant will be assigned to UNODC Office for Eastern Africa, based in Nairobi, Kenya and will work under supervision of the UNODC ROEA Criminal Justice Expert and GTZ CBV Component Leader.

Duties and Responsibilities

The main objective of the assignment is to develop training manual and curriculum for Kenya Prosecutors and Police officers to strengthen their capacity to effectively respond to gender-based and sexual violence in line with applicable legislation and international standards. The manual shall also include measures to prevent sexual violence against women and children, ways to respond to and investigate acts of violence, including forensic investigation, and resources to meet the needs of victims with specific focus on assistance and rehabilitation.

The objective will be achieved through performance of the following tasks:

1. Conduct research and desk review of existing training manuals, curricula and materials as well as the existing legislative framework regarding sexual offences and gender-based violence in Kenya, including:

• 2006 Sexual Offences Act with Amendments of 2007 and 2009 and regulations therein;
• 2006 Witness Protection Act with Amendment of 2010 and regulations therein;
• State Law Office Reference Manual for Prosecutors on sexual offences;
• Police Training Manual on Gender and Human Rights (FIDA, 2008);
• Draft rules of court on sexual offences;
• Draft training materials for police prosecutors developed by the WJEI Senior Legal advisor;
• Judgments and recent jurisprudence emerging from the courts on SOA and their implications;
• National Guidelines on management of sexual violence in Kenya (Ministry of Public Health and Sanitation, 2009) and other relevant materials.

2. Develop a comprehensive training manual and curriculum on sexual offences and gender-based violence for Prosecutors and Police officers, based on the revised and updated United Nations Model Strategies and Practical Measures to Eliminate Violence against Women in the Field of Crime Prevention and Criminal Justice and on the UNODC Handbook on Effective Police Responses to Violence against Women and the related Training Curriculum, adapted to the local needs. The training material will be also based on methodologies and principles of adult learning.

3. Conduct the initial ToT workshop for a selected group of Prosecutors and Police officers, based on the developed manual and curriculum, with participation of representatives of key victim assistance services. The training also intends to test the draft training material, which shall be revised based on the lessons learned/ feedback from the workshop.

4. Develop model Charge Sheets under the SOA and Penal Code on SGBV;

5. Provide interim and final reports, including recommendations for further training needs of the beneficiary, as well as development of the protocols and standard operating procedures (SOPs), submitted at the end of the assignment respectively.

The consultant will report to UNODC Criminal Justice Expert and GTZ GBV Component Leader and be based in Nairobi, Kenya. The consultant is expected to be present at the duty station in Nairobi, Kenya, at least 90% of the duration of the assignment. UNODC and GTZ will provide necessary support to the consultant.

Competencies
-Strong interpersonal and communication skills.

-Culturally and gender sensitive.

-Good analytical and drafting skills.

-Computer literacy.

-Oral and written fluency in English.
Required Skills and Experience
Education:
• Master’s Degree in criminology, law, sociology or related discipline.

Professional experience:

• At least 5 years of relevant professional experience in and extensive knowledge of investigation and prosecution of cases of gender based and sexual violence;
• Extensive professional experience in the area of training on issues of sexual and gender based violence, including in international settings;
• Proven and extensive experience in the development of training curricula and materials;
• Ability to interact with governmental agencies, good interpersonal skills and organizational proficiency;
• Excellent communication and drafting skills in English, both orally and in writing;
• Knowledge of the criminal justice system in Kenya and Eastern Africa is highly desirable.

Other considerations:
-The assignment will be billed monthly based on a daily rate. The daily rate is payable against actual working days dedicated to the project as well as monthly progress reports.

The submitted plan will be evaluated in terms of the quality of complete coverage of all aspects of the terms of reference, timeliness in relation to research, analysis and production of a draft report as well as compliance with qualifications as provided for herein.

A former bank employee wants Sh45.6 million in compensation for alleged sexual harassment by her boss.

Ms Jane Gichuki, 33, said she was forced to quit her job as a portfolio manager with Standard Chartered Bank because she could not withstand the conduct of her immediate boss, Mr Ben Muchina.

She termed his body language as “suggestive”, which made her uncomfortable during the two years she worked at the bank. “I was continually intimidated and subjected to sexual harassment. He also made statements about Kenyan women that suggested his sexual interest,” she said.

The former manager said she turned down unsolicited offers to meet her boss for drinks after working hours.

She is seeking payment for loss of earnings for 20 years she could have worked for the bank before attaining the mandatory retirement age of 55 and medical and counselling expenses amounting to Sh45,655,000.

Ms Gichuki has named Mr Muchina, an expatriate from Zimbabwe, and the Standard Chartered Bank as the defendants. Lawyer Chacha Odera, for the bank, said the allegations had been denied and would put the plaintiff to strict proof on the same.

Ms Gichuki alleged that her former boss insinuated to her that she would obtain a favorable appraisal at work if she gave in to his sexual advances.

She asserted that due to her boss’ actions and victimization occasioned by the bank, she “suffered psychologically” and had to get medical treatment.

She blamed the bank for failing to take action even after she repeatedly lodged complaints and that it failed to recognize her outstanding achievements by giving her a poor performance rating in 2006.

But the bank set up a tribunal on June 12, 2007, to investigate her allegations, which she said did not apply to her since she had resigned from their employment on June 5, 2007. Lady Justice Ruth Sitati yesterday adjourned the hearing to January 25, 2011, for the bank to be served with the suit documents.

The amount of money Ms Jane Gichuki wants to be paid in compensation for alleged sexual harassment.
