TERMS OF REFERENCE

Assessment of Implementation of the SNC “Guidelines for Risk Management & Accountability for NGOs operating in Somalia/Somaliland” (October 2014)

BACKGROUND:

NGO Consortium members have provided humanitarian and development assistance to communities in all regions of Somalia and Somaliland for decades. The operating environment in Somalia is highly challenging and complex, due to continuing conflict, lack of, weak or contested governance, high levels of criminality, and restricted humanitarian access to populations in need. For a long time, NGOs have encountered both security and operational challenges to their engagement in Somalia and yet have maintained their role of addressing the persistent needs of the communities they work with. In many areas, International NGOs have and continue to deliver assistance through their national partners or have resorted to remote management or third party monitoring of interventions.

NGO interventions have however been met with evidence of fraud, aid diversion and insufficient levels of accountability. This has put in question the levels of accountability that NGOs have to the vulnerable communities that they target in interventions and to their donors in terms of application of effective and efficient risk mitigation mechanisms. With the incremental improvements in access in parts of South Central Somalia over the last year as well as relative improvements in structures and systems for NGO engagement, focus on effective and accountable aid delivery in Somalia is increasing further. Many NGOs have invested significant resources including capacity into strengthening their internal risk management and accountability practices. This has not always been effectively communicated externally. Nor have many NGOs shared information with one another in an effort to approach the issue collectively.

In June 2014 the SNC commissioned a study on NGO approaches to risk management and accountability best practice in Somalia. As a result, members of the Consortium developed and endorsed the “Guidelines (Code of Conduct) for RMA practises for NGOs operating in Somalia / Somaliland”. They also committed to undertaking an assessment of the implementation of the risk management guidelines, with an objective to build momentum towards strengthening risk management approaches and fully implementing and striving towards best practice.

Definition of ‘risk’:

Programme implementation / project activities by necessity take place in ‘high-risk’ contexts; Somalia is a particularly acute example as it is affected by protracted armed conflict, recurring natural disasters and poor local governance. Risk can be understood as the possibility of ‘future harm’.Risk is broader than the possibility of aid being diverted before it reaches the designated beneficiaries, though this is evidently a central concern in South and Central Somalia. Risk is commonly categorised into three inter-connected types:

Contextual:factors which are external and often outside of humanitarians’ control;Programmatic:the risk of not meeting programme objectives, not meeting needs and potentially doing harm;Organisational:consequences for the security and safety of staff and for organisations’ reputations.

DESCRIPTION OF THE ASSIGNMENT:

Objective:

The objective of this assessment is to map out and conduct an evidence based analysis of current NGO implementation of the aforementioned “Guidelines” at all levels of program implementation in Somalia. The goal of this initiative is to identify the effectiveness of the risk systems put in place by agencies and to build momentum to strengthen risk management approaches. This will allow Consortium members to not only promote accountability and transparency but also report on steps taken towards mitigating risk. Ultimately the aim is to improve the quality and effectiveness of risk management practice by agencies through increased accountability.

The commissioned assessment will assess evidence for:

1) implementation of the guidelines,

It will provide recommendations on:

2) good practices identified and / or instituted following lessons learnt through positive and negative implementation of practical risk mitigation;

3) a review and possible revision of the risk management guidelines.

The scope of the assessment will extend to agencies’ risk assessment steps / procedures, tools used and structures put in place to guide risk mitigation before programme interventions, as well as checks during programming and actions taken (if any) to manage incidents.

The overall assignment will be consultative and will make use of a mixture of qualitative methods of data collection, including semi-structured interviews, focus group discussions and workshops.

Activities to be carried out:

1) Preparatory work and desk review - 2 days

Initial desk review of process and documents leading up to the formulation and endorsement of the “Guidelines on risk mitigation for NGOs working in Somalia/Somaliland” and “Code of conduct and risk management”.Outline of planned report format, based on challenges and best practices as experienced by the agencies.Review of assessment methodology.Review of external approaches to risk mitigation monitoring.

2) Interviews and study of internal agency documents - 10 days

Interviews with signed up NGOs to identify specific examples where the “implementation of the risk guidelines” are being met (a core target group of the 27 NGOs that have endorsed the guidelines) and tools usedInterview with CHF to see how this aligns with the CHF specific RMA approaches

3) Report / Tool consolidation and write up - 3 days.

4) Develop/design and implement training on RMA structures and revision of Consortium risk management guidelines – 5 days.

Deliverables / Output:

A report on risk mitigation good practices as experienced by agencies operating in Somalia (what is viable -v- what is not). This report will detail progress against each of the 6 Code of Conduct areas without detailing individual agencies’ responses. Gaps will be identified and recommendations of where agencies should focus their effortsRevised draft risk management guidelines.Capacity Assessment Guide / Tool that can be used as a point of reference and check list by agencies operating in Somalia.Proposed benchmarks on implementation of the guidelines (where agencies are now and where they would ideally like to be in the future)Training plan on implementation and use of the capacity assessment guide / tool and at least one training executed with key stakeholders (SNC will support organisation of the event).

REQUIREMENTS

Good understanding of Somalia (including power dynamics) and the operating conditions for NGOs providing assistance in SomaliaFamiliarity with Somalia NGO ConsortiumProven experience undertaking strategic evaluationsGood written and spoken English. Knowledge of Somali would be of added benefit.

Oxfam’s Kenya Programme is a complex programme that incorporates both rapid and slow onset emergencies as well as longer term development and policy work. Oxfam Kenya applies a one programme approach which means it has multiple activities that support a holistic approach to humanitarian, development and advocacy for long lasting change in poverty reduction.
Oxfam Kenya is engaging in the great changes taking place in Kenya including the devolution of government, preparation for peaceful elections, the discovery of Oil in the Arid Lands and the expansion of informal urban settlements. Oxfam in Kenya works in the north, principally in Turkana, Dadaab and Wajir, Nairobi and on national level advocacy and coordination issues in multi stakeholder fora. To this end, we are seeking to fill the following positions:
 Contract: C2 National - Fixed term; 21 months
Reporting to the Deputy Program Manager, the WASH Team Leader will provide day to day operational technical leadership for the planning and implementation of Oxfam GB’s public health programme in Turkana District. Working with Rift Valley Water Services Board and two other INGOs – Practical Action and IRC, the WASH team leader will ensure effective and efficient programme implementation that is accountable and relevant to beneficiaries according to the objectives, results, timeframe and specifications of the donor(s).
To be successful in this role, you should have at least a first degree in a relevant field such as Civil Engineering or water Engineering from a recognised university/college with some experience in public health and hygiene promotion interventions in emergency situation especially in drought context and intense relevant practical experience with an NGO. He/she should have assessment, analytical and planning skills, with an ability to translate analysis into recommendations for practical action, including proposal development. Knowledge and experience of the application of SPHERE and links to longer-term development practice coupled with proven experience of effective integration of gender in WASH programming.
He/she will have knowledge, understanding and a commitment to linking hygiene promotion with water and sanitation activities coupled with good communication and interpersonal skills and ability to work well within a team. You will have diplomacy and tact, to be able to liaise, negotiate and plan with government officials, other agency staff, local artisans and community representatives. You will have the ability to cope in remote rural locations and travel extensively within project areas. Knowledge of local language would be advantageous.Contract: D2 National - Fixed term; 6 months
The Human Resource & Admin Officer will play a lead role in providing interpretation of HR policies on a daily basis to the programme teams. He/she will be required to support the recruitment process and ensure they are in line with Oxfam procedures. The HR & Admin Officer will track and manage contract changes in terms of renewals and reviews. Management of staff holidays will be part of his/her daily routine while working hand in hand with the HR/Admin Assistant to ensure that key staff information is up to date.
You will ensure that staff medical records are up to date and that all medical related issues are handled with utmost confidentiality. In liaison with the relevant persons, you will perform other administrative duties including organization of staff and visitor’s travel, office maintenance, ensuring procurement of office supplies is done within a timely period and overseeing that the office layout meets the health and safety standards.
The HR & Admin Officer will represent Oxfam in HR meetings with other partners in the area and ensure that any staff issues raised are addressed effectively.
To be successful in this role, you will have a university degree in Human Resources Management or Business Management coupled with development or humanitarian work experience preferably with an NGO. You should have good interpersonal and people management skills as well as excellent written and oral communications skills in English and Swahili. You should be flexible to travel within short notice and in difficult circumstances.
 Monitoring Evaluation Accountability & Learning (MEAL) Officer Contract: D2 National - Fixed term; 12 months
Reporting to the Program Manager in Wajir, the MEAL Officer will establish and manage the MEAL system of OXFAM and its partners’ programmes in order to ensure programme quality and effectiveness. You will be responsible for the development of the MEAL system for key OXFAM Kenya’s programme focus areas of Water, Sanitation and Hygiene (WASH), Food Security and Livelihoods, Policy and Advocacy and Peace Building and Conflict Management. You will establish a systematic way to jointly monitor programmes, facilitating internal and external evaluations and document learning from programmes.
He/she will compile monthly reports, participate in various technical meetings and provide support in the preparation of reporting requirements. The post holder will be responsible for the establishing accountability system and ensure programmes are implemented in an accountable fashion. You will work with the MEAL Coordinator to operationalize the country MEAL framework ensuring the links between country level MEAL activities and regional systems. The MEAL officer will be responsible for coordinating assessments and carrying out data analysis thereby providing requisite information for setting programme benchmarks. He/she will use various data collection methods including Participatory Rural Appraisal (PRA) methods and produce various reports.
To be considered for this position, you will possess a minimum of a Bachelor’s Degree in International Development, Public Health, Project Management, Disaster Management or Statistics from a recognised university or closely related fields. In-depth demonstrated “hands-on” working experience in MEA is essential. You must have experience in capacity building of partners in MEAL and conversant with data analysis softwares especially SPSS.

Introduction
Tr?caire has received funding from the European Commission to implement interventions geared towards improving access to justice, and enhancing accountability and protection of human rights in Kenya for a period of 23 months. This funding will support Tr?caire and 4 Kenyan NSAs:

• To enhance the capacity of NSAs to influence and monitor justice sector reforms and,
• To facilitate improved access to justice for the most vulnerable, marginalized and poor

The expected results of this action are:

• Involvement and participation of NSAs in policy design and reforms in the administration of justice sector increased
• Access to justice for the most marginalized, vulnerable and poor in rural and urban areas and penal institutions improved

One of the key strategies of this action will be use of advocacy to rally support for and bring legislative, policy and administrative changes at local and national level in order to enhance access to justice in Kenya. The media, both print and electronic have become a critical tool for awareness raising, shaping opinion and influencing change locally and globally. In appreciation of this critical role, and the need to engage with the media in a strategic and consistent manner that delivers results for Kenyans, a collective training will be organized for partners of the implementing organ early on in the roll out of the project.

The objectives of the training are as follows:

• To enable participants appreciate the vital role the various media play in advocacy and in particular governance and human rights-related advocacy;
• To equip participants with the necessary knowledge and skills to engage media in public advocacy.

Duration

The training is scheduled to take 4 days; 7th to 11th February 2011

Expected Outputs of the Training

• Conduct a 4 day training for 10 participants;
• An understanding of ‘how to do advocacy through media’ guide will be developed
• A workshop report and a partner-specific media advocacy work plan;
• Recommendations on how best to follow up on the training
